Many people who live in condos are wondering what is the real punishment that can apply to those neighbors who repeatedly and systematically do not pay the common expenses of the community. Let’s look at some things: penalty for non-payment of the common expenses. Isn’t no mystery that money coming into the funds of the condominium for common expenses is what allows the operation of the same. One of the major problems faced by an administrator of condominiums is usually the arrears in the payment of the common expenses. This situation is so complex that it may mean the cessation of operation of basic services such as electrical services, drinking water, etc.; the devaluation of the property, common property, among other problems. We must understand that the timely payment of the common expenses in a community is an obligation that each owner has on his property.
Without the payment of the same, a community simply cannot perform, to consequence that the Administration may not meet with a myriad of obligations undertaken by the community and which are of utmost relevance. The importance of the common expenses for a community is of such magnitude, that is not excessive to assimilate that have taxes to a State. The above statement, do not hesitate to assimilate such contingency, for example, is as relevant to the payment of taxes we do all citizens in favor of the State. Professor tributarista Catalina Garcia Vizcaino in relation to the question why we pay taxes responds: because the State has the need to provide resources to meet needs (explanation of economic and financial character). In this way, came to the conclusion some relevance that constitute the monies flowing into a community by concept of common expense. For this reason we propose the need to amend the statute that regulates this matter in real estate co-ownership scheme.
